2.2 Third-Party Trademarks
All other trademarks, service marks, trade names, logos, and brand names displayed on our platforms are the property of their respective owners. The use of any third-party trademarks does not imply endorsement, sponsorship, or affiliation with such third parties, and Upvista Digital disclaims any association with such marks except as expressly stated.

3. PERMITTED USES
3.1 Limited License
Subject to your compliance with this Notice and all applicable terms and conditions, Upvista Digital grants you a limited, non-exclusive, non-transferable, revocable license to access and view Content solely for your personal, non-commercial use, provided that you retain all copyright and proprietary notices.
3.2 Fair Use and Fair Dealing
You may use Content in accordance with applicable fair use, fair dealing, or similar exceptions under copyright law, such as for purposes of criticism, comment, news reporting, teaching, scholarship, or research, provided that such use does not infringe upon Upvista Digital's rights or violate this Notice.
3.3 Client Deliverables
With respect to deliverables created specifically for clients pursuant to a written agreement, ownership and usage rights shall be governed by the terms of such agreement. Upon full payment and satisfaction of all obligations, clients typically receive ownership or license rights to deliverables as specified in the applicable Statement of Work or Service Agreement.
4. INTELLECTUAL PROPERTY INFRINGEMENT
4.1 Respect for Intellectual Property
Upvista Digital respects the intellectual property rights of others and expects all users of its platforms and services to do the same. We prohibit the use of our platforms or services in any manner that infringes upon the intellectual property rights of Upvista Digital or any third party.
4.2 Infringement Claims

4.3 Counter-Notification

5. USER-GENERATED CONTENT
When you submit, post, upload, or otherwise provide content to Upvista Digital's platforms or services ("User Content"), you retain ownership of any intellectual property rights you hold in such User Content. However, by submitting User Content, you grant Upvista Digital a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with Upvista Digital's business operations, marketing, and service delivery.
You represent and warrant that: (a) you own or have the necessary rights to grant the license described above; (b) your User Content does not infringe upon the rights of any third party; and (c) your User Content complies with all applicable laws and regulations.
Upvista Digital reserves the right to remove, edit, or refuse to publish any User Content that violates this Notice, applicable laws, or Upvista Digital's policies, in its sole discretion.
6. THIRD-PARTY CONTENT AND OPEN SOURCE
6.1 Third-Party Content
Our platforms and services may incorporate or link to content, software, libraries, frameworks, or other materials owned by third parties. Such third-party content remains the property of its respective owners and is subject to the terms and conditions, licenses, and restrictions imposed by such owners.
6.2 Open Source Software
Upvista Digital may use open-source software in the development of its services and deliverables. Open-source components are subject to their respective open-source licenses, which may include requirements for attribution, disclosure of source code, or other obligations. Upvista Digital complies with the Digital Millennium Copyright Act (DMCA) and similar copyright laws in other jurisdictions. 8. ENFORCEMENT AND REMEDIES
Upvista Digital takes intellectual property rights seriously and will vigorously enforce its rights against any unauthorized use, reproduction, distribution, or exploitation of its Content or Trademarks. Violation of this Notice may result in:
- Immediate termination of access to our platforms and services.
- Legal action seeking injunctive relief, damages, and recovery of attorneys' fees and costs.
- Criminal prosecution where applicable under intellectual property laws.
